Terms of Service

The rules for using ReCall. Plain English, no legalese where we can help it.

These Terms of Service ("Terms") govern your access to and use of ReCall ("Service"), operated by Valitura, LLC ("we", "us"). By signing up, you agree to these Terms. If you don't agree, don't use the Service.

1. Who can use ReCall

You must be at least 18 years old and legally able to enter contracts. If you're signing up on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Your account

Keep your password secure and your contact info current. You're responsible for all activity under your account. Tell us right away if you suspect unauthorized access.

3. What you're paying for

ReCall is a subscription service that answers missed calls with SMS, triages leads with AI, and syncs bookings to your calendar. Plans, pricing, and included volumes are shown on the Pricing page. Subscriptions renew automatically each period until cancelled.

4. Billing, renewals, and cancellations

  • Payments are processed by Stripe. We never see or store your card details.
  • Fees are charged in advance for each billing period (monthly or annual).
  • You can switch plans anytime — Stripe automatically prorates the difference.
  • You can cancel anytime from Billing → Cancel subscription. Your account stays active until the end of the current billing period; no partial-period refunds. See our Refund Policy for exceptions.

5. Acceptable use

You agree NOT to use ReCall to:

  • Operate the phone number or SMS conversations in any way that is deceptive, fraudulent, or misleading to callers about who they are communicating with.
  • Impersonate another person or business, or misrepresent the nature of the automated responses callers receive.
  • Violate the TCPA, CAN-SPAM, CTIA guidelines, A2P 10DLC requirements, or any other applicable telecommunications or marketing law.
  • Use the Service to send unsolicited bulk SMS, spam, or any outbound messages not responding to an inbound caller who initiated contact.
  • Engage in unlawful activity — including harassment, financing of illegal goods or services, violations of sanctions, export controls, or local laws.
  • Abuse, overload, probe, reverse-engineer, scrape, or interfere with the Service or its underlying infrastructure (including Twilio, Anthropic, OpenAI, Google, Stripe, Emergent, and Resend).
  • Resell, sublicense, or white-label the Service without our written consent.

We reserve the right to suspend or terminate accounts that violate this section — with or without notice — and to cooperate with carriers, regulators, or law enforcement.

6. Your data

You own your customer data. We store and process it on your behalf strictly to deliver the Service, as described in our Privacy Policy. We won't sell your data or use it to train third-party AI models outside the transactional AI features you use.

7. Third-party services

ReCall integrates with Twilio (voice + SMS), Google Calendar, Stripe (payments), Anthropic Claude and OpenAI Whisper (AI features), and Resend (email). Your use of those services through ReCall is also subject to their terms.

8. Service availability

We work hard on uptime but don't guarantee the Service will be uninterrupted or error-free. Scheduled maintenance and upstream outages happen. We're not liable for missed calls or texts during outages beyond our reasonable control.

9. Intellectual property

ReCall's software, branding, and content are our property (or licensed to us). You get a limited, non-exclusive, non-transferable license to use the Service while your subscription is active. That's it — no other rights transfer.

10. Warranty disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability for any claim arising from your use of ReCall is limited to the amount you paid us in the 12 months preceding the claim. We're not liable for lost profits, lost revenue, or indirect, incidental, special, consequential, or punitive damages.

12. Indemnity

You'll defend and indemnify us from any third-party claim arising from your content, your use of the Service, or your violation of these Terms or applicable law (including SMS/TCPA compliance).

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or in-app at least 14 days before taking effect. Continued use of the Service after the effective date means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Florida.
